FREE TRIAL TERMS

Access to the free trial for the Football Manager Live Service ('the Service') will be provided to you following delivery of an email from SEGA Europe Limited ('SEGA') confirming successful registration for the free trial. These free trial terms and conditions ('Free Trial Terms'), together with the Conditions of Use, Privacy Policy and additional documents and notifications which SEGA may provide you with from time to time, constitute a legal agreement between you and SEGA under which you are permitted to access the Service free of charge for a period of no more than 21 days ('Free Trial').

1. Free Trials are subject to availability. SEGA reserves the right to withdraw the Free Trial at any time.

2. Free Trials are only available to new subscribers of the Service. Previous subscribers or triallists do not qualify for a free trial.

3. The Free Trial is available only once to one person and to only one member of a household. Subsequent Free Trials by the same person at any address, or by another person at the same address, are not permitted.

4. You must have internet access and valid payment details to redeem the Free Trial offer.

5. The period for your Free Trial will start on the date that SEGA notifies you of successful registration and will last for a maximum of 21 days from notification ('Free Trial Period')

6. [Cancellation requests in respect of the Free Trial must be completed online via the "My Account" section of the Football Manager Live website. Once in "My Account", you should select "Manage Billing" where you will then be required to register a billing password. Once you are in the Billing section, go to "My Account" where you will have the option to cancel your subscription. If you cancel during the Free Trial Period, your Free Trial will end immediately and you will no longer be entitled to access the Service. Cancellation requests will only be valid if made (i) during the Free Trial Period, and (ii) in accordance with these Free Trial Terms.]

6. Unless you cancel prior to the end of the Free Trial Period, upon expiry of the Free Trial Period:

a. your subscription to the Service will begin on the terms of the subscription/payment plan that you have selected and the Payment Terms will apply;

b. SEGA will begin billing you and will continue to bill you by your chosen payment method on the payment dates of the subscription/payment plan you have selected (minimum subscription period 3 months);

c. payment will continue to be taken by SEGA in this manner until you cancel your chosen subscription/payment plan in accordance with the relevant terms and conditions; and

d. for the avoidance of doubt, the Conditions of Use and Privacy Policy will also continue to apply to your subscription.

7. In case of cancellation and/or termination of your free trial at any time, SEGA in its sole discretion will reserve Your Account, team name, achievements, statistics and all other related information ('Game Data') for a period of 2 years. SEGA will use reasonable endeavours to ensure that the Game Data is made available to you in the event that you subscribe to the Service at a later date within 2 years following cancellation. However, SEGA does not warrant that it will retain the Game Data for future use by you and you agree that following cancellation or termination you will have no further rights to the Game Data. You acknowledge that you shall have no claim or remedy against SEGA arising from the disposal or deletion of the Game Data by SEGA following cancellation and/or termination of your subscription.

8. The Conditions of Use, Privacy Policy and Rules of Conduct apply to your use of the Service during the free trial.

9. SEGA RESERVES THE RIGHT, AT ITS SOLE DISCRETION, TO SUSPEND OR TERMINATE YOUR ACCESS TO THE SERVICE IF YOU FAIL TO COMPLY WITH THESE FREE TRIAL TERMS, THE CONDITIONS OF USE OR PRIVACY POLICY.

10. You must be at least 13 years of age to subscriber to and access the Service. By accepting these Free Trial Terms and submitting a request for a Free Trial, you warrant and represent that you are at least 13 years of age. If you are under 16 years of age, you should ask your guardian or parent to read and accept these Free Trial Terms before proceeding to registration for the free trial.

11. These Free Trial Terms shall be construed in accordance with and governed in all respects by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English Courts.

12. SEGA, AT ITS SOLE DISCRETION, MAY MODIFY THESE FREE TRIAL TERMS AT ANY TIME IN ANY MANNER WITHOUT ANY LIABILITY TO SEGA. IN SUCH CIRCUMSTANCES SEGA WILL PLACE THE UPDATED PAYMENT TERMS UNDER THE 'My Office' TAB ON YOUR ACCOUNT HOMEPAGE. THE UPDATED FREE TRIAL TERMS WILL BE INCORPORATED INTO THE AGREEMENT AND YOU WILL BE DEEMED TO AGREE TO AND ACCEPT THESE UPDATED FREE TRIAL TERMS. IT IS YOUR RESPONSIBILITY TO CHECK YOUR 'My Office' TAB REGULARLY FOR ANY SUCH UPDATES.

PLEASE NOTE THAT THESE PAYMENT TERMS ONLY APPLY TO USERS WHO ARE PROCESSING THEIR PAYMENT THROUGH THE FOOTBALL MANAGER LIVE WEBSITE. IF YOU HAVE OBTAINED A VOUCHER CODE BY PROCESSING YOUR PAYMENT WITH A THIRD PARTY CERTAIN SECTIONS OF THESE PAYMENT TERMS WILL NOT APPLY TO YOU AND YOU SHOULD CONSULT THE PAYMENT TERMS OF SUCH THIRD PARTY. IF YOU HAVE PROCESSED YOUR PAYMENT WITH A THIRD PARTY AND YOU WISH TO CONTINUE YOUR SUBSCIPTION AT A LATER DATE BY PROCESSING YOUR PAYMENT DIRECTLY WITH SEGA THEN YOU SHALL BE BOUND BY THE PAYMENT TERMS BELOW.

Access to the Football Manager Live Service (‘the Service’) is provided to you immediately following delivery of an email from SEGA Europe Limited (‘SEGA’) confirming your subscription order. If you agree to these Payment Terms you will be legally committing to a minimum Subscription Period (as defined in paragraph 1 below) which will be determined by the subscription plan you select.

These Payment Terms, together with the Conditions of Use, Privacy Policy and additional documents and notifications which SEGA may provide you with from time to time, constitute a legal agreement between you and SEGA under which you are permitted to access the Service (together, ‘the Agreement’).

Please read the following terms carefully:

MINIMUM SUBSCRIPTION PERIOD

1. Before you create your Football Manager Live account (‘Your Account’) and submit your payment details, you will be able to choose your minimum subscription period for the Service. The currently available minimum subscription periods are for 3 months, 6 months, 12 months or 24 months (each a ‘Subscription Period’). No other subscription periods are available. In return for the Subscription Fee (as defined in paragraph 2 below) and subject to your compliance with the Agreement you will be entitled to unlimited access to the Service for the duration of your selected Subscription Period.

SUBSCRIPTION FEES

2. Access to the Service provided by SEGA is conditional on you paying a recurring fee for each Subscription Period which is described in detail when you select your subscription plan (the ‘Subscription Fee’). Please note that the Subscription Fee does not include internet service provider costs or any telephone costs that might be incurred by you in accessing the Service. The Subscription Fee for each Subscription Period can be paid by selecting one of the following two payment methods (which are described in more detail on the Payment Processing page):

(a) Pay by Recurring Subscription- The Subscription Fee for the Subscription Period is payable in full in a single payment in advance of you being granted access to the Service for your Subscription Period. Once your subscription order and payment method has been accepted by SEGA, you will automatically be charged the appropriate Subscription Fee in full for your selected Subscription Period upon commencement of the Service and the Subscription Period. Such Subscription Fees are subject to automatic renewal, in accordance with clause 4 below; or

(b) Pay by Monthly Instalments- The Subscription Fee is payable in equal monthly instalments during your Subscription Period. Once your subscription order and payment method has been accepted by SEGA, you will automatically be charged the first monthly instalment of the Subscription Fee upon commencement of the Service. Each additional monthly payment will then be automatically collected on the same date of each month thereafter during the Subscription Period. As you will note from the Payment Processing Page, this method of payment is slightly more expensive than the Pay by Recurring Subscription method set out above. Such Subscription Fees are subject to automatic renewal, in accordance with clause 4 below.

3. The payment of the Subscription Fee is made on secured web pages during the set up of Your Account. All payments are made in Pounds Sterling. The price plans for each Subscription Period for both (a) the Pay by Recurring Subscription and (b) the Pay by Monthly Instalments methods available are detailed on the Payment Processing page. You must provide SEGA with complete, correct and up to date billing information which will enable SEGA to collect the Subscription Fee at the appropriate time. By submitting such billing information to SEGA, you are representing that you are the individual authorised to incur charges through the selected payment method. SEGA reserves the right to limit the number of user accounts that may be charged to a credit card or other payment or identification method per unique user.

AUTOMATIC RENEWAL OF SUBSCRIPTION PERIOD

4. The Subscription Fees for both (a) the Pay by Recurring Subscription and (b) the Pay by Monthly Instalments methods consist of recurring fees and are NOT one off payments, subject to your right to cancel your subscription. To enable you to enjoy continued uninterrupted access to the Service, at the end of your minimum Subscription Period, subject to your right to cancel below, the Subscription Period will automatically renew for a further Subscription Period of the same length and as such the Subscription Fee will also become payable on commencement of the renewed Subscription Period. This process will continue in perpetuity so that your Subscription Period will continuously automatically renew unless you cancel your subscription to the Service prior to the expiry of the appropriate Subscription Period. If for example, you have elected to pay for 3 months of the Service in advance, after 3 months access to the Service you will automatically be granted a further 3 months access on expiry of the initial 3 months, and the Subscription Fee will become payable on commencement of this further 3 month period.

5. Further to the above, the billing date for the Subscription Fee for all subsequent Subscription Periods following the initial Subscription Period shall be:

(a) Pay by Recurring Subscription- the quarterly, 6-monthly, yearly or biennel (2 year) anniversary (where relevant) of the due date of the last Subscription Fee paid by you (except where you have participated in the Recommend a Friend Scheme as detailed below); or

(b) Pay by Monthly Instalments- the monthly anniversary of the due date of the last monthly instalment of the Subscription Fee paid by you (except where you have participated in the Recommend a Friend Scheme as detailed below).

6. Where you have participated in the Recommend a Friend Scheme, more details of which can be found on the Football Manager Live Website, the billing date for the next Subscription Fee will be postponed by the same period as the payment-free period you are entitled to by participating in the Recommend a Friend Scheme. For example, if you Recommend a Friend who subscribes for a 3 month Subscription Period, you would be entitled to a 15 day payment free-period (or such other period that may be offered by the Recommend a Friend Scheme from time to time) and your billing date would be extended by 15 days accordingly. You will be notified in advance of your new billing date for the next Subscription Fee. By accepting these Payment Terms, you hereby authorise SEGA to deduct the Subscription Fee on the new billing date notified to you.

7. SEGA is not responsible for any charges or expenses which you incur (whether arising from overdrawn accounts, exceeding credit limits or otherwise) resulting from charges billed by SEGA (or any third party payment processing entity engaged by SEGA) in accordance with this Agreement.

8. By providing appropriate billing information and submitting your subscription order, you authorise SEGA to continue charging the payment method for the Subscription Fee due to SEGA for all successive Subscription Periods unless you cancel your subscription in accordance with this Agreement.

CANCELLATION OF SUBSCRIPTION - GENERAL

9. The Service will be accessible immediately following delivery of an email by SEGA accepting your subscription order. AS A RESULT, UPON RECEIPT OF THIS ACCEPTANCE EMAIL YOU WILL BE LIABLE TO PAY THE SUBSCRIPTION FEE FOR THE MINIMUM SUBSCRIPTION PERIOD YOU HAVE SELECTED.

10. You may cancel your subscription to the Service at any time during a Subscription Period by providing at least 48 hours' notice to SEGA prior to the expiry of such Subscription Period. Instructions detailing the cancellation process will be contained within the confirmation email sent to you following SEGA's acceptance of your subscription order. However, you will be able to access the Service up until such Subscription Period ends. YOU WILL NOT BE ENTITLED TO A REFUND FOR THE REMAINDER OF ANY SUBSCRIPTION PERIOD AFTER CANCELLING YOUR SUBSCRIPTION IN ACCORDANCE WITH THIS AGREEMENT AS THE SERVICE WILL BE AVAILABLE FOR YOUR USE UP UNTIL THE SUBSCRIPTION PERIOD ENDS.

11. If you do not cancel your subscription by providing at least 48 hours' notice prior to the expiry of a Subscription Period as referred to above, you will be responsible for the Subscription Fee for the subsequent Subscription Period and SEGA will charge you such Subscription Fee on the date the subsequent Subscription Period commences in accordance with this Agreement.

12. In case of cancellation and/or termination of your subscription at any time SEGA in its sole discretion will reserve Your Account, team name, achievements, statistics and all other related information (‘Game Data’) for a period of 2 years. SEGA will use reasonable endeavours to ensure that the Game Data is made available to you in the event that you subscribe to the Service at a later date within 2 years following cancellation. However, SEGA does not warrant that it will retain the Game Data for future use by you and you agree that following cancellation or termination you will have no further rights to the Game Data. You acknowledge that you shall have no claim or remedy against SEGA arising from the disposal or deletion of the Game Data by SEGA following cancellation and/or termination of your subscription.

NO REFUNDS POLICY

13. SEGA WILL NOT REFUND THE SUBSCRIPTION FEES COLLECTED FROM YOU IN ANY CIRCUMSTANCES (UNLESS SUCH SUBSCRIPTION FEES HAVE BEEN COLLECTED BY SEGA IN ERROR).

14. WITHOUT PREJUDICE TO YOUR RIGHT TO CANCEL YOUR SUBSCRIPTION DETAILED WITHIN THIS AGREEMENT, THE SUBSCRIPTION FEE FOR EACH SUBSCRIPTION PERIOD STARTED WILL BE DUE AND WILL NOT BE REIMBURSED. FOR THE AVOIDANCE OF DOUBT YOU ARE NOT ENTITLED TO ANY REFUND OR REIMBURSEMENT ON THE BASIS THAT YOU DO NOT ACCESS THE SERVICE DURING THE SUBSCRIPTION PERIOD FOLLOWING CANCELLATION OF YOUR SUBSCRIPTION BY YOU.

CHANGES TO SUBSCRIPTION FEES

15. SEGA reserves the right, at its sole discretion, to increase or decrease the amount of the Subscription Fees. If it elects to exercise this right, SEGA will post a notification on the Football Manager Live Website at least 14 days before the changes to the Subscription Fees are effective. The new Subscription Fee will only be applicable at the date of your automatic Subscription Period renewal.

16. If you do not agree with the changes to the Subscription Fees referred to above, you may exercise your right to cancel your subscription prior to the end of your current Subscription Period as detailed above. If you do not cancel your subscription prior to the commencement of your next Subscription Period in accordance with this Agreement, you will be deemed to have accepted the modified Subscription Fees.

GENERAL

17. SEGA RESERVES THE RIGHT, AT ITS SOLE DISCRETION, TO SUSPEND OR TERMINATE YOUR ACCESS TO THE SERVICE IF YOU FAIL TO COMPLY WITH THESE PAYMENT TERMS. IN SUCH CASE, YOU WILL NOT BE ENTITLED TO ANY REIMBURSEMENT OF SUBSCRIPTION FEES.

18. If you are under 16 years of age, you should ask your guardian or parent to read and accept these Payment Terms before proceeding to payment.

19. These Payment Terms shall be construed in accordance with and governed in all respects by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English Courts.

20. SEGA, AT ITS SOLE DISCRETION, MAY MODIFY THESE PAYMENT TERMS AT ANY TIME IN ANY MANNER WITHOUT ANY LIABILITY TO SEGA. IN SUCH CIRCUMSTANCES SEGA WILL PLACE THE UPDATED PAYMENT TERMS UNDER THE ‘My Office' TAB ON YOUR ACCOUNT HOMEPAGE. THE UPDATED PAYMENT TERMS WILL BE INCORPORATED INTO THE AGREEMENT AND YOU WILL BE DEEMED TO AGREE TO AND ACCEPT THESE UPDATED PAYMENT TERMS. IT IS YOUR RESPONSIBILITY TO CHECK YOUR 'My Office' TAB REGULARLY FOR ANY SUCH UPDATES.

These terms and conditions do not affect your rights under law.

I hereby acknowledge that I have read and understand the foregoing PAYMENT TERMS and agree that by ticking the 'I Agree' box I am acknowledging my agreement to be bound by these PAYMENT TERMS.
